Augmenting AI in Intellectual Property Jurisprudence

Artificial intelligence technologies are rapidly growing and transforming industries¹ where it challenges on IP law which are required re-evaluation. It is rapidly replacing the human intelligence to automate tasks, solve problems, make decisions basically all tasks done by the humans. AI is also dominating in the field of Intellectual property rights. This paper mainly focuses on how AI is completely taking over the rights which was given to protect the artistic works, innovation, data driven outputs. The main objective is to find whether intellectual property law is able to tackle the crises of AI and how it is going to protect the human inventions.

This paper begins with history of development IP law , how AI is emerging in IP laws , liability in context for AI using human’s innovations and creating problems with related cases, statues and international legal developments. Research also determines how the current IP law makers the establish the rights to protect the human innovation and make sure it can be differentiated and tell who is the real owner of such creations. WIPO published the report how AI is affecting innovation, patents and IP laws globally². WIPO plays a key role in addressing emerging issues i.e. AI. It also highlights the risks reliance on AI which could undermine the human creativity which effects the balance between the intellectual property law seeks to maintain between the public and innovation.

This paper concludes that AI is not completely taking over the Intellectual property rights it is reshaping if not addressed properly AI would replace it completely in absence of proper law. Therefore there is a urgent need for legal reforms to address the AI related crises where it can protect the human inventions with advancing technologies.
