Abstract
The rapid development of Generative Artificial Intelligence (AI) technology is going to cause revolutionary changes concerning intellectual property rights, particularly, regarding the notions of authorship and ownership linked with creativity. The development of tools creating literary, visual and audio art without a human contribution provokes serious concerns about the foundations of the copyright laws, which presuppose the creative activity of individuals as a condition for copyright protection. In this regard, this study aims at examining the impact of the copyright law on the AI-generated works through addressing the questions concerning authorship and copyrights issues. In this work, the doctrinal and comparative research method will be applied. In particular, the problem of copyright of AI-generated products will be analysed in terms of legal provisions regulating this process. Firstly, the possibility of copyright on the AI-generated materials will be considered. The key focus will be made on the issue of distribution of the ownership rights among parties, including developers, users and artificial intelligence. Secondly, the question of copyright infringement related to unauthorized use of copyrighted works for AI training purposes will be examined.
