ABSTRACT

The rapid advancement of artificial intelligence (AI) has fundamentally transformed the landscape of intellectual property (IP) law, raising complex and unprecedented legal challenges. AI systems are now capable of generating creative works, inventions, and innovations with minimal human intervention, thereby blurring the traditional notions of authorship, inventorship, and ownership. This paper critically examines the intersection of AI and IP regimes, focusing on copyright, patent, and trademark frameworks. It analyses whether existing legal doctrines are adequately equipped to address issues such as AI-generated works, liability for infringement, and the allocation of rights between developers, users, and AI systems.

The study further explores key judicial and policy developments across jurisdictions, highlighting the inconsistencies and gaps in current regulatory approaches. Particular attention is given to the question of whether AI can be recognised as a legal author or inventor, and the implications such recognition would have on innovation and public interest. Additionally, the paper evaluates concerns relating to data usage, algorithmic transparency, and the potential monopolisation of AI-generated outputs.

In light of these challenges, the paper argues for a balanced and adaptive legal framework that preserves incentives for innovation while safeguarding ethical considerations and equitable access. It suggests the need for international harmonisation and policy reform to ensure that IP laws remain relevant in the age of intelligent machines. Ultimately, the paper contributes to the ongoing discourse on how law can effectively respond to the evolving capabilities of AI.
