Abstract
The rapid expansion of digital technologies and e-commerce has transformed marketing practices, making intellectual property rights (IPR) a critical component of competitive strategy. This study explores the intersection between digital marketing and IPR, emphasizing the need to protect intangible assets such as brand identity, content, and innovative advertising techniques. The paper examines key legal challenges, including copyright infringement, trademark misuse, piracy, and issues related to data protection and privacy in digital environments. It further analyzes the role of various IPR tools—such as copyrights, trademarks, patents, trade secrets, and licensing frameworks like Creative Commons—in safeguarding marketing content.
Additionally, the study highlights technological protection mechanisms including Digital Rights Management (DRM), cryptography, digital watermarking, and electronic signatures as effective strategies to combat unauthorized usage. The research underscores the importance of regulatory frameworks such as data protection laws in governing digital marketing practices. It concludes that while digital marketing offers immense opportunities for business growth, it also necessitates robust IPR strategies to ensure legal compliance, protect creativity, and sustain competitive advantage in a rapidly evolving digital economy.
