The fast-paced adoption of Artificial Intelligence (AI) into the national security and law enforcement models is radically changing the global legal and technological situation. The implementation of AI-based surveillance, both in its facial recognition form and predictive policing algorithms, in India is a tricky convergence of the state security considerations and the very idea of the right to privacy. The current paper will discuss the new law and regulatory issues that arise in the context of these technologies, in particular, the influence of automated data processing and continuous online surveillance on personal autonomy and the constitutional privacy guarantees.One of the most important aspects of this discussion is that of digital sovereignty. With data turning into a strategic asset, the dependence on proprietary AI ecosystems that transnational entities often operate begs serious questions on the jurisdictional control and equity in the world.

The paper evaluates the conflict between the role of the state to guarantee the safety of the people and the need to safeguard the human rights in the enlarged digital areas. It also examines how sufficient the current Indian legal systems are to deal with algorithmic transparency and how digital transgressions can be inflicted that would subvert democratic protections.This study is a synthesis of the views of criminal law, security studies, and intellectual property to recommend a rights-based approach to AI governance. It stresses the necessity of a strong human rights due diligence and a re-understood concept of sovereignty that places emphasis on equitable access to knowledge and protects against the elimination of civil liberties. Finally, the paper gives a conceptual map on how to go about the changing relationship between the development of AI and the safeguarding of world equity in the digital era.
