AI, Intellectual Property, and Emerging Legal Challenges: Towards a Framework of Global Governance

Abstract

The rapid expansion of artificial intelligence (AI), especially generative AI, has disrupted traditional intellectual property (IP) systems as it questions established principles of authorship, inventorship, and ownership. This article analyses how AI and IP law intersect against the backdrop of global governance structures that are still in the process of being developed. It points out that national legal frameworks are still fragmented and insufficient to handle international AI issues such as data scraping, AI-created works, and law enforcement across borders. Employing doctrinal and comparative methods, the article highlights significant legal gaps and suggests a global governance model that is harmonized and based on transparency, accountability, and fair access. The paper ends by emphasizing that internationally coordinated legal changes are vital in reaching a middle ground between promoting innovation and protecting the rights of creators.
