Abstract
The rapid advancement of Artificial Intelligence (AI) is transforming the landscape of intellectual property rights (IPR), challenging traditional legal frameworks that are primarily designed around human creativity and authorship. This study examines the evolving intersection between AI and IPR in India, highlighting the regulatory gaps and legal ambiguities surrounding authorship, ownership, and protection of AI-generated works. It explores how AI enhances intellectual property management through improved efficiency, data analysis, and enforcement mechanisms such as digital watermarking and blockchain-based authentication.
Despite these advantages, significant concerns persist regarding originality standards, inventorship, accountability, and the use of copyrighted data in training AI systems. A comparative analysis of international frameworks, particularly from the United Kingdom and the European Union, reveals more adaptive approaches toward AI governance. The paper argues that India’s existing legal regime is fragmented and inadequate to address emerging technological realities. It concludes by emphasizing the need for AI-specific legislative reforms and global harmonization to ensure a balanced approach between fostering innovation and protecting human intellectual contributions.
