Abstract: The rapid growth of AI technology has led to a huge increase in "Dark Data," which is digital data that is not organized, indexed, or looked at by organizations. AI technology has the potential to change the world, but its heavy use of large data sets could lead to even more dark data being created. This paper contends that Dark Data constitutes a significant threat to Digital Sovereignty and intellectual property protection. When data is dark, it will be outside the law and open to being taken by AI.

The current study delineates the Dark Data Audit Framework as a method to identify the risks linked to dark data. The research shifts the emphasis from the costs associated with data management to the ramifications of data mismanagement, particularly concerning the violation of individual rights related to human rights, notably the right to privacy and the right to be forgotten. The research also talks about the problem of the greenwashing paradox that comes with storing dark data digitally.

This research will provide a solution for scholars and policymakers to regain digital sovereignty through auditing, which will not only safeguard intellectual property but also promote global fairness and equality through the utilization of AI technologies.
