Algorithmic Governance and Social Justice: Legal Dimensions of AI in Reinventing the Welfare State

Abstract: The integration of Artificial Intelligence (AI) into governance frameworks has emerged as a transformative force in advancing inclusive development across public health, education, and welfare sectors. This paper critically examines the role of AI-driven technologies in enhancing accessibility, efficiency, and equity in the delivery of public services. In public health, AI facilitates predictive analytics, disease surveillance, and personalized healthcare interventions, thereby improving early detection and resource allocation. In the education sector, AI-powered tools enable adaptive learning, bridging socio-economic and geographical disparities by providing personalized and scalable educational opportunities. Similarly, in welfare governance, AI enhances beneficiary identification, targeted service delivery, and real-time monitoring, reducing leakages and ensuring transparency.

However, the deployment of AI in governance also raises significant legal, ethical, and policy concerns, including data privacy, algorithmic bias, digital exclusion, and accountability deficits. This study adopts a multidisciplinary approach, combining doctrinal legal analysis with policy evaluation and comparative perspectives, to assess the regulatory frameworks governing AI in public administration. It further explores the challenges faced by developing economies, particularly in ensuring that AI systems do not reinforce existing inequalities.

The paper argues for a rights-based and human-centric approach to AI governance, emphasizing the need for robust legal safeguards, inclusive data practices, and institutional accountability. By proposing policy recommendations aligned with global best practices, the study contributes to the discourse on leveraging AI as a tool for achieving sustainable and inclusive development, while safeguarding fundamental rights and social justice.
